Regardless of what did or did not happen with mutual consent, this was ongoing for a year. At which time there were multiple red flags that should have warranted further inquiry. I do not accept the inept excuse that he was sleeping. He undressed me to whatever extent, molested me, and redressed me. That is purely premeditated.
Furthermore, even a husband cannot engage in intimacy with his own wife if she cannot consent. Sleeping, inebriated, or whatever the case may be, no consent, means no.
They lack the necessary information. If key facts are withheld or there is deliberate deception, any apparent consent may be invalid.
